Former President Trump's Team Seeks Supreme Court Permission to Fire Leading Intellectual Property Official

The ex- leader's government on Monday petitioned the US Supreme Court to permit the termination of the head of the American copyright authority.

This emergency appeal follows about a month and a half after a national appeals court in Washington ruled that the director, Shira Perlmutter, could not be solely fired.

Almost four weeks prior, the entire District of Columbia circuit court refused to reconsider that ruling.

This case is the most recent in a series of disputes concerning executive authority to appoint preferred leaders at government offices.

The High Court has generally allowed such actions, even as court challenges continue.

However, this particular case concerns an office inside the national library. Perlmutter acts as the register of copyrights and also counsels Congress on copyright matters.

The solicitor general, D John Sauer, stated in the legal document that, regardless of ties to the legislative branch, the director “wields administrative power” in regulating intellectual property rights.

Perlmutter claims she was terminated in May because the former president disapproved with recommendations she gave to lawmakers in a report concerning artificial intelligence.

She allegedly received an email from the administration informing her that her role was “terminated effective immediately,” as stated by her office.

A split appellate panel decided that Perlmutter could keep her position while the case moves forward.

“The Executive's claimed blatant meddling with the work of a Legislative Branch official, as she performs statutorily approved duties to counsel Congress, appears to be a violation of the separation of powers,” stated Judge Florence Pan for the appellate panel.

Justice J Michelle Childs joined the ruling. Both judges were appointed to the appellate court by Democrat President Joe Biden.

In dissent, Justice Justin Walker, a former president's nominee, wrote that Perlmutter “exercises executive authority in a host of manners.”

Perlmutter's attorneys have contended that she is a well-known intellectual property specialist. She has served as register of copyrights since former head librarian Carla Hayden selected her to the role in October 2020.

The ex-leader appointed deputy attorney general Todd Blanche to replace Hayden at the Library of Congress. The administration had fired Hayden following complaints from conservatives that she was promoting a “woke” agenda.
